Licensing Overview
NetworkActiv AUTAPF is available under three different commercial licences: Enterprise Licence, Hybrid Site Licence, and Machine Licence. The enterprise licence entails a company-wide licence, which may span across multiple facilities. This hybrid site licence essentially permits for the software to be used on all the customer's machines at a facility, such as an office or datacentre. The site may be relocated as needed, so long as the pertaining software copies are installed and used on only one site at a time. Machine licences are available in various package sizes to accommodate an assortment of projects. For a given machine licence pack, the machines must all be owned and or primarily operated by the same person or organisation. Having these options enables you to make the most of your investment. ▌-- Licensing is necessary --▐
Any using, copying, and distributing of this software requires a prior licence granted by the copyright holder. Before being granted any such licence, you must explicitly accept the specific, legally-binding licensing terms pertaining to this software. Without your acceptance of these terms, you are not permitted to use, copy, nor distribute this software, neither in part, nor in whole.
▌-- English is herein the language of jurisdiction --▐
This agreement text may be presented to you in a translated or transcoded format for your convenience. However, the legally-binding terms are those specified in the original, English-language version of this text. By accepting these terms, you are accepting to be bound by the English-language version of this contract.
▌-- The type of licence dictates additional terms --▐
The copyright holder offers different types of licence to this software. These types include and shall be referred to herein as: Enterprise Licence; Hybrid Site Licence; Machine Licence; and Trial Licence. Each of these three types of licence has additional licensing terms dictated by those paragraphs mentioning the specific licence type, as titled in this paragraph. All paragraphs not referring to one or more specific type of licence apply to all types available. The specific type of licence granted, if any, may visibly be mentioned in the software’s “About” window. In-program mentioning is for reference only and may appear in a translated form, depending on the chosen user-interface language. Your modification of or tampering with the displayed type of licence does not change the type of licence granted, if any.
Each copy of the software may be of a different type of licence, depending on which type was granted by the copyright holder when the pertaining licence was issued. Copies of the software pertaining to a registered licence must contain and display the registration number of the licence, which serves to identify and differentiate one licence from another.
Copies pertaining to the Trial Licence may lack a registration number. If you hold a trial licence, you are hereby granted the right to install and use the pertaining copies on any number of computers. These copies may contain and impose usage restrictions, usage limitations, and or trial reminders (“nags”), and you agree to accept any such restrictions, limitations, and reminders. Copies pertaining to the trial licence may be distributed at no charge. The manner of distribution must not whatsoever be annoying, offensive, or otherwise spam-like in nature. Any distributed copies must be intact, unmodified, and unmasked. Distribution must not include or link to malware, adware, or spyware. Any recipients must agree to these licensing terms before using or further distributing the software.
Holders of a Hybrid Site Licence, as issued by the copyright holder or its authorised distributors, are hereby granted the right to install and use the pertaining software copies on all machines permanently situated at a designated facility. If any machine of the designated facility should leave the site, the pertaining copy of this software must not be used on this machine until the machine returns to the facility. In addition to the designated facility, a copy pertaining to the hybrid site licence may be installed and used also on an additional, portable machine, such as a laptop or notebook computer. This additional machine may change location from time to time, so long as it occasionally -- at least once per year -- visits the designated facility. The designated facility may not span more than one postal address. All machines, including the portable machine and the machines at the designated facility, must be owned and or primarily operated by the holder of the pertaining hybrid site licence.
The designated facility pertaining to a particular hybrid site licence may be changed from time to time, but the pertaining copies of this software must promptly cease use and be removed from all machines of the previously designated facility. Likewise, the designated portable machine as well may be changed from time to time, so long as the pertaining copies of this software are promptly retired and removed from the previously designated machine.
Holders of an Enterprise Licence, as issued by the copyright holder or its authorised distributors, are hereby granted the right to install and use the pertaining software copies on all machines owned and or primarily operated by the holder of the pertaining enterprise licence.
Holders of a Machine Licence, as issued by the copyright holder or its authorised distributors, are hereby granted the right to install and use the pertaining software copies on a number of machines not exceeding the quantity of machines specified by the purchased licence package. All such machines must be owned and or primarily operated by the licensee. Each machine licence has a registration number and a machine count. These numbers should be visible on the software’s “About” window. Software copies may be occasionally retired and removed from one machine, followed by installation and usage on another machine, but the former and latter machine both must be owned and or primarily operated by the licensee. Software copies pertaining to a particular machine licence must not, at any moment, be used on a number of physical machines exceeding the official machine count issued for the licence.
For the purposes herein, a single machine is a computer having one mainboard. Supercomputers and other machines having multiple mainboards are herein considered to be multiple machines. Usage of this software on more than two virtual machines of a physical machine mandates the designation of more than one machine’s portion of a licence. Specifically, each additional two virtual machines running simultaneously acts as an additional physical machine for the purposes of these licensing terms, even if only one such additional virtual machine is deployed. One physical machine plus up to two of its virtual machines constitutes one physical machine.

Licensing terms may change with future releases or updates. Available licence types also may change. Certain updates may be available to prior licence holders at no charge. Other updates or releases may require purchasing new or updated licences -- the details of which may depend on the type and quantity of licence held previously. Paid upgrades may or may not be available at a discount.
▌-- The licensee is the first and final entity --▐
At the final termination of use by the original licensee, the pertaining licence is considered to have been consumed and must not be transferred to another entity. For the purposes herein, a business that acquires an existing business through acquisition of all assets is considered to be the same entity, even if not the same party. However, the acquiring business party first must agree to these licensing terms before it may continue to use or install copies of this software linked to the acquired licences of this software.

This software is provided on an "as is" basis. The copyright holder expresses no guarantee of the fitness, usability, reliability, performance, or compatibility of this software. You agree that the copyright holder is not whatsoever accountable for any need or requirement of the licensee or end user that remains unmet, whether in part or in whole. The copyright holder makes no guarantee of the existence of future updates or fixes for any particular problem. This software is in no manner considered to be bug free, and it may contain bugs and glitches capable of causing severe damages, losses, disruptions, et cetera.

You agree to hold the copyright holder wholly unaccountable for any and all damage, loss of data, loss of business, loss of goodwill, loss of privacy, loss of or damage to reputation, and loss of funds that arise out of or from your use of this software. Possible causes of such loss and damage include but are not limited to bugs, glitches, lack of fitness, lack of usability, lack of reliability, lack of performance, and lack of compatibility. Additionally, you agree that the copyright holder may at some point, possibly without notice, cease to produce software and cease to provide all or some of the related services, such as downloads. You agree that it is your responsibility to backup any downloaded or purchased copies of this software. You accept any and all risk from failure of the copyright holder to provide related services.
The copyright holder is in no way responsible for anything undesirable that arises out of or from your use and or misuse of this software, including your violation of local, state, and or federal laws and regulations, whether of domestic or foreign jurisdiction.
Upon your acceptance of this agreement, you permit the storage and usage of this software on any computer systems on which you install or use this software, under the licensing terms as dictated by this agreement. You understand and accept all parts of this agreement. You accept the full responsibility of any and all possible risks of using this software and its related services.

The copyright holder of this software reserves and retains all pertaining legal rights. This software, including its source code and binary code, is therefore protected under copyright laws of the United States and elsewhere. Portions of the binary code -- specifically the MFC and VC 11 Runtime Libraries -- are copyright © Microsoft Corporation, and these portions are dictated by the licensing terms set by Microsoft.
▌-- California, the United States, is the default jurisdiction --▐
The default jurisdiction is the State of California, United States of America. The licensee may offer to have disputes handled in another jurisdiction. The copyright holder may or may not agree to do so. If the parties cannot agree to a jurisdiction other than the default, the matter shall be handled in the default of the United States of America by a California Court with a California Judge.
▌-- Unlawful portions can be revised to fit the intention of the copyright holder --▐
If any parts of this agreement are proven to be unlawful or unenforceable by law, those parts shall be revised, for the purposes of the hearing, to represent the intention of the copyright holder, in such to become lawful and legally enforceable.

Availability and Ordering
Login credentials for your registered copy download will be provided shortly after your order is placed -- usually within 15 minutes. If no e-mail is received within 20 or so minutes, please let NetworkActiv know via e-mail so that your order can be expedited. Your credentials will be delivered on the e-mail address provided, probably return-addressed as support@networkactiv.com. As these e-mail messages are sometimes lost, it may be recommended to white-list the source address in your spam filters before placing your order. Checking your spam/junk/bulk folder may also yield results if no timely message has found you.
eChecks: Paying by eCheck necessitates clearance -- perhaps over three days -- before credentials can be supplied. For this reason, eChecks should be avoided when reasonable.
Payments are processed via PayPal. The process is secure and provides convenient payment options. Creating an account is optional as credit cards are accepted directly without the need to log in.
